Okay, so I just left off a phone call with my attorney (his specialty is criminal law, but he's a close friend, so he's handled other matters for me and I keep him on retainer) and here is what he had to say, more or less: It's like trying to put out a million tiny fires. Unless and until someone publishes your work under his or her own name in any profitable format, preferably in a physical entity format (a book, as opposed to an ebook) there's really no legal recourse except the DMCA. I'm kind of at the "fuck it" point now; he's going to talk to a friend who is a copyright attorney, but until I hear back from my own attorney, I'm not going to do anything.fY3ocJVNmzOP0GLQ

I used to care a whole lot more, but you know what? Each time we go after one site, another one will pop up and do the same thing. It is a never ending cycle. When you post ANYTHING online, you're risking the chance of it being stolen. Be it photos, stories, art work, music, whatever the case may be. That is just, sadly, how the internet works. Sure, you can chase them down, but as I said, more sites will pop up and keep it going. If you want to spend your days chasing them down, more power to you. But, me? I really can't be arsed.

I've had mine stolen repeatedly, and yes I email them. But has been pointed out, its like weeding. they always come back, and then I've spent hours of my time for what? Possibly this is why I am a terrible gardener.

I'm very glad for the care Lush verifiers put into ensuring that those who post here are posting original work. I'm even more glad that Gav puts as much work as he does into attempting to maintain the security of the site. But as long as I have even one pirated download(book, song, or movie) on my hard drive, I have no reason to complain.

The way I see it, when I write a story and publish it in the public domain, then it's no longer mine - it becomes public property in some way - people will read it and do what they do. If there's an audio version, they can save that to listen to over and over.

I guess this must be how musicians and bands feel when people download their music without paying? Or when people share stuff on FB without crediting the original poster or person who made/wrote it...

As for stopping writing and contributing? Well, I don't get paid for it, it's not like they're stealing from my purse. I just do it because I want to, it's a hobby. I'll keep writing here because it does me good and also because people seem to enjoy what I post - if they enjoy it somewhere else without my say so, well, that does suck a bit, but at least they're still reading it... The only person I'd be punishing by not writing would be myself.

Anyway, those are my thoughts.

I am with clum on this one. I am sorry for all of you who have had stories stolen and I understand your frustration - you have every right in the world to be pissed. However I have learned (the hard way) to pick my battles and this is just not one of them.
First off, I am not in the habit of getting into fights I can't possibly win. Even if we bombard these sites and get them closed down, another will pop up like tissues in a Kleenex box as soon as we do. This is like our troublemakers on Lush - they disappear in one place only to pop up somewhere else under a new name. In addition, since some of these sites are in foreign countries, there isn't a whole lot that can be done to pressure them into compliance anyway.
Next, I have not been shy in telling you all that I write my stories for me first of all. My writing is therapeutic for me - it helps me express the dreams, fantasies and feelings that otherwise would drive me out of my flipping mind. So writing, whether accepted or not, whether stolen or not, helps me. The fact that others like my stories is icing on the cake. And the fact that someone would go to the trouble of stealing my story is in a twisted way a compliment!
Is it right - no. Should these people be punished for their crime - sure. But if everyone was called on every thing they did wrong in this world, the Internet would be a far different and far lonelier place!

Also, I don't write upon Lush Stories to make money... I have never published so much as an Ebook... HOWEVER... IF IT COMES TO MY ATTENTION that any INDIVIDUAL is attempting to make MONEY off my work then I will see the motherfucker in court since I can PROVE that what I write is mine and mine alone. (This extends to Intellectual Copywright in terms of Character and plot...) A background in the music business, and (to a MUCH lesser extent) the movie business, has taught me that a threatened law-suit tends to 'cur beaginin smacht ar' (In English, "Put a bit of fucking fear/respect into") people who are fucking me around...

Through my array of emotions today, this video kept me laughing...

I make a formal complaint simply to ensure that I'm covered in the event money is ever made of my work (not at all likely, but one can always hope)

I received a PM this morning alerting me to all of this. It upset me because I honestly feel that, at the very least, they could leave the name of the writer on the story or poem. As my mother says, there is no honor amongst thieves. I went through hell and back to get a contact email. I'm not good at that kind of thing at all. I should have known to contact Sprite. I sent several emails and tried to get several comments attached to my stolen work. DancingDoll, you are the best. I did not have the faintest idea of what to write. If I had that shell earlier... It's all very stressful and I've been at the hospital with my mom most of the day.

But, then I ran across this thread...

I'm so proud to be a member of this community. You guys are absolutely great. Possibly (thank you for the PM sweetie), Sprite, DancingDoll and all of you who went into action as soon as this thread went up. It is like having a team on your side. It's really what makes this community special. You will not find that on other sites.

This exactly why one should NOT be complacent with things such as copyright material and ownership.

With people spending the hours as we did in addressing our rights, good things happened.

You won't ever see me being grateful that "at least people are reading my work" when I have not given permission to use my work and some pirates have snatched my work. I think the results are well-worth the four plus hours addressing my stolen work to three sites.

To all those who don't care and those that did e-mail the offenders ... at least two sites no longer have your work (or mine) .... and that is something to be grateful for.

As has been explained on countless occasions, if YOU can read a web page, it can be scraped programmatically.

Gav could write a program to extract the HTML of any website in 5 minutes, no matter what measures have been put in place.

Even if we made lush a pay site, someone could join up for a month, and use that login for their program to gain entry.

Name me ONE web site where you can't view their HTML, please, humour me.
