Dominion Voting Systems vs. Fox News Defamation Lawsuit: Is this a one-off, or is there more to come?

I'm sure you all know by now that Dominion Voting Systems is suing Fox News for $1.6 billion for defamation in the wake of them airing/supporting claims that Dominion helped to rig the 2020 election using their voting machines/technology.

Even as of today, there have been last-ditch attempts made to settle out of court, but things are set to head to trial tomorrow, April 18, 2023.

What I'm wondering is if this is a one-time thing, or if Dominion is eyeing more lawsuits if this one is successful. If it's the latter, then serious consequences are up ahead for smaller entities who made and/or supported the same claims as Fox News.

This will be the only lawsuit. They could bring charges to individuals but that’s harder to prove and not going to result in any money.

Dominion wanted this to go to trial; the damage to their reputation and personal safety for the staff and their families was huge. The sticking factor for negotiating a settlement in this case is Dominion refusing to accept any settlement where Fox does not admit to any wrongdoing. That’s par for the course in corporate settlements but Dominion wants more than money here, they want it full and without legal question that nothing said about the company was true at all. They want Fox to publicly admit it was all lies to keep gullible viewers hooked. Obviously Fox knows that admitting that could result in many other lawsuits from other agencies.

In the case itself Fox has very few legal arguments. The judge kneecapped most of their potential defenses before the trial started. A legal defense would be that Fox actually believed what they were reporting to be true. Judge says there is far too much evidence from discovery that they knew it was all BS so they can’t argue that in front of a jury. The other defense would be that since newsworthy people (such as Trump himself or Rudy G) were saying it they were simply reporting that. Judge says they can’t make that argument since it was clear that they were pushing only one position and they ignored and argued against those who opposed it.

Last defense that Fox can’t make is that the issue was solely with Fox News and not it’s parent company so only the network is responsible. Depositions with the Fox producers and Murdoch have proved that not only did they have the parent company’s blessing, they were told to silence reporters who fact checked on air any of the claims against Dominion because they feared they would lose their hardcore audience to fringe networks.

The real question here is this; will a successful Dominion lawsuit expose Fox to many more lawsuits from businesses and individuals it slandered over the years behind the guise of ‘being discussed by newsworthy individuals.’ This trial will have a large affect on liable and slander laws as it pertains to news organizations and what their responsibility is to fact check and report the truth.

Last fun note is that Fox has avoided these sort of lawsuits in the past by claiming they are an entertainment network and not a news network, and the people watching know this so they can say anything they want since it’s covered by parody laws.

Too bad they settled. I would've loved to see Fox News get convicted for their deliberate lies.

But then again, it might have scared journalists who honestly try to report the truth as they know it, out of fear for being sued for possible errors on their side.

They had to admit that they were lying. Plus, there is another lawsuit too. Losing a billion dollars won't cripple them but at least it teaches them to not just straight up lie with no consequences. Even if they didn't settle though, Americans who listen to FOX News nightly don't care. They think it's all a big conspiracy to silence them and they think they are the oppressed ones. They see Democrats and leftists as the fascists and nothing will change their minds.

Smartmatic will soon get it's bite of the Fox apple orchard. I and millions of Americans hope they don't cease their lawsuit because Fox negotiates a settlement seeking to pay just half of what Smartmatic has filed for. They can get awarded payment and bring Fox to its knees with a legal decapitation.

Fox has repeatedly tried to have the case thrown out, making the same argument that failed in the Dominion case—calling it “baseless” and likening it to a “full-blown assault on the First Amendment.” Unfortunately for Fox but fortunately for everyone who feels robbed today, a New York judge has already allowed the case to move forward, citing in a 61-page ruling Fox’s “reckless disregard for the truth.”

Is the Dominion settlement good news for Smartmatic? Its lawyers sure seem to think so. The chest-thumping statement was out within minutes of the news, and the lawsuit is somewhat swaggering itself, opening with, “The Earth is round. Two plus two equals four. Joe Biden and Kamala Harris won the 2020 election for President and Vice President of the United States.”

It cites more than 100 alleged false statements made on the network. At least one analysis said it “appears to be the more dangerous” of the two major defamation suits, though the piece also notes New York has very strong First Amendment protections. (Fox News is also being sued by a former producer for the network who claims Fox tried to get her to lie about Dominion ahead of the trial.)

The Smartmatic case isn’t as far along as Dominion’s yet, raising the possibility of more entertaining discovery to come.

Dominion and its lawyers got their money, but what needed to happen, which was Tucker Carlson's viewers hearing him apologize for knowingly presenting falsehoods to them, did not happen, and that's the thing America needed the most. It's a shame, but Fox won. You saw their 'mea culpa'. It was pure bullshit that none of their viewers will notice.

I've never seen a Dominion owned or manufactured 'voting machine'. I had no idea what they look like. I looked 'em up with Google images. Still haven't seen one in action - I'm guessing they are touch screen tech.

At my voting location - after establishing your identity and residence and voting eligibility - an election judge hands you a ballot with small circles printed next to candidates names for their various positions or offices they are campaigning for and you have to use a black ink pen to fill in the 'entire' area inside those small circles.

Apparently the marking pens can't be blue ink or felt-tipped pens nor pencil lead. Of course, this is in backasswardsville - so maybe the judges were just being smallville hicklets with their instructions to me.

You then take your appropriately marked up and finished ballot to a tabulating machine which resembles an office copier which phototronically reads your marked selections on the ballot which you yourself must insert into the vote tabulator.

Unless it is equipped wirelessly to transmit those records elsewhere - I fail to see how those particular units could be hacked or tampered with as I know the building where this occurs and I did not notice any cabling ran to the tabulator besides a power line which was plugged into a wall.

A judge told me that the tabulator stores all the votes gathered, electronically on a thumb drive for ease of transportation. I assume this particular model must also have an internal SSD or hard drive to record data to, as well.

In the future, I hope to see the newer Dominion voting screens installed everywhere with their manufacturing name proudly displayed, so as to trigger future MAGA - or perhaps even turn them away from their voting precinct 'in protest'.

Don Lemon got fired too. I know it's unrelated to Dominion and Fox News and all of that, but there are already those trying to conflate and compare the two. Don got fired at the tail-end of an ongoing investigation of inappropriate behavior, and it's a surprise to no one.

Tucker was surely fired because of the role he played in spreading misinformation about a "stolen" election.

I’m surprised it took this long to ditch Carleson after the Dominion discovery. Text messages that tore down Trump and his own viewers. There’s also a few sexual harassment cases related to Tucker as well floating around.
